This policy describes how Kwant Software (Björn Billooye, Nederwijk 242, B-9400 Ninove, info@kilogain.com) collects, uses and shares consumer health data. It is meant for residents of Washington State and Nevada and for anyone whose consumer health data is collected there, under the Washington My Health My Data Act and Nevada's consumer health data law (NRS chapter 603A, SB 370).
1. Consumer health data we collect
We only collect consumer health data if you sign in to the Kilogain app with an account. Without an account it stays on your device and we collect none.
- Body weight, body measurements and your goal weight that you enter, only if you gave your separate consent for this in the app.
- Workout data that you enter: exercises, sets, weights, repetitions, times, plans and set targets. We treat this as consumer health data to the extent that it can say something about your physical condition.
Progress photos are never collected; they stay on your device. We don't collect location data, biometric data or data from sensors or other apps, and we don't derive health information about you from other data.
2. Where it comes from
Only from you: what you enter in the app yourself.
3. Why we collect it and how we use it
Only to provide the service you ask for: to store a backup of your data and make it available on your other devices. We don't use it for advertising, marketing, profiling, research or the training of artificial intelligence models, and we collect no more than that purpose needs. We will ask for your consent before using it for any other purpose.
4. What we share, and with whom
We don't share consumer health data with third parties or affiliates, and we don't sell it. There is therefore no list of third parties or affiliates with whom it is shared.
Our processor Supabase (Supabase, Inc.) stores the data on our behalf and on our instructions only, to provide the service to you. RevenueCat, Netlify and Google receive no consumer health data from us.
5. Your consent
We collect consumer health data only with your consent, or to the extent necessary to provide the backup you asked for. For body weight, body measurements and goal weight you give that consent separately in the app: with the tick box when you sign in, or later with the switch “Body weight and measurements in backup”. You can also sign in without giving it; that data then stays on your device. We would ask for a separate consent before sharing it, and for a separate signed authorisation before selling it; we do neither.
6. Your rights and how to use them
- Confirm and access: you can ask whether we collect, share or sell your consumer health data, and get a copy, including a list of the third parties and affiliates with whom we shared or to whom we sold it and an email address or other online way to reach them. “Export CSV” in the app gives you the copy yourself.
- Withdraw consent: you can withdraw your consent to the collection and sharing of your consumer health data. For body weight, measurements and goal weight you do this with the switch “Body weight and measurements in backup” under “Settings” → “Backup” in the app; for everything else, by signing out, by deleting your account or by email.
- Delete: you can have your consumer health data deleted, with “Delete account” in the app, through this page, or by email. We also instruct our processors to delete it. Server backups, where they exist, are kept for no more than 7 days.
- Nevada: you can also ask us to stop collecting, sharing or selling your consumer health data.
Send your request to info@kilogain.com. We may ask you to confirm it from the email address of your account. We answer within 45 days, free of charge, and don't treat you differently because you used your rights.
7. Appeal
If we refuse your request, you can appeal by replying to our message or by emailing info@kilogain.com with the subject “Appeal”. We answer in writing within 45 days and explain our decision. If your appeal is refused, you can complain to the Washington State Attorney General at www.atg.wa.gov/file-complaint, or to the Nevada Attorney General at ag.nv.gov.
8. Changes
If this policy changes, we update this page and the date at the top, and ask your consent again where the law requires it.
